Focusing on South Korean biologists and their efforts to establish national parks in the 1960s and 1970s, I illuminate the ways in which they negotiated their relationship with the ecological diplomacy of the International Union for Conservation of Nature (IUCN) and the anti-communist and developmentalist diplomacy of the South Korean government. To justify their activities, these South Korean biologists emphasized the importance of nature conservation activities in the competition for international recognition and economic development with their northern counterparts. (...) The national-park initiative was thus subsumed into the politics of this legitimacy competition between the two Koreas, or what I call ‘victory-over-communism’ diplomacy. The IUCN's influence over South Korea was limited to the extent that both the government and scientists recognized the diplomatic merit they could gain in the context of their Cold War competition and developmentalism. It is also shown how, during the short detente period of the two Koreas, South Korean biologists used victory-over-communism diplomacy to renew their government's attention to their activities. This Korean episode contributes to the wider perspective of decentralizing the Cold War history of environmental diplomacy in the free-world bloc by illustrating the importance of its entanglement with the Cold War politics surrounding Asian developmentalism. Piłsudski’s achievements in those years are numerous and important, they include among others: the definition of Poland’s borders after military victories over the Ukrainian, Bolshevik and Lithuanian armies and in result of insurgencies in (...) Wielkopolska and Silesia, the securement of international recognition for Poland, the construction of parliamentary democracy and local government, the promotion of a national service ethos through schools, the church, the armed forces and the media. The glorious anniversary of the great victory of the Soviet people and their heroic armed forces over the most aggressive armies of international imperialism provides a perspective that makes it possible to see the importance of this feat on the scale of world history, in the vivid light of the favorable influence it has exercised on all the subsequent development of sociopolitical processes on earth.

The historical meaning of the dissolution of the Soviet Union and of the subsequent post-communist transformation remains profoundly unclear. Most observers hesitate to designate these events as a revolution, building on a common-sense notion of revolution as a violent, radical change. My dissertation argues that the post-communist transformation was indeed a revolution and proves this claim by comparing it with the French Revolution, in its political, social, and anthropological aspects. In both historical cases, the quick and easy victory of (...) society over the "old regime" was followed by a long period of internal struggle, threat of stagnation, and widespread melancholia. ;Based on this historical parallel, I turn to the theoretical analysis of the concept of revolution. Our recent historical experience allows for a new perspective on the history of this concept, as it has been developed in the Modern philosophy and political theory. The present study focuses primarily on two points in this history. The first is Immanuel Kant's treatment of the French Revolution in his late political texts, The Conflict of the Faculties and The Metaphysics of Morals. The second is Hannah Arendt's work On Revolution. The close reading of these texts allows me to outline the structure of the concept of revolution as centered around the logic of negativity. ;Kant interprets the French Revolution as an irreversible event. The revolution repeatedly returns to the imaginary, impossible point of self-foundation only to recoil again from the abyss it opens. Arendt also emphasizes the two sides of revolution, the infinite self-destruction and the new beginning. Although Arendt attempts to separate the "positive" American Revolution from the "negative" French Revolution, the dissertation shows that her conceptual reading of the two is identical and that it heavily depends on the narrative structure of tragedy. ;Revolution is the central concept of the Modern philosophy of history. It is far from being outdated but must be updated and renewed to provide meaning to our present historical situation. This dissertation makes a step towards this renewal. (shrink)

This contribution aims to outline the birth and development of the Unione Donne Italiane in regard to its relations with the Partito Comunista Italiano from 1944 to 1963.The present research has drawn mainly from archival sources.UDI was born as a multi-party women’s organization but the hegemony of the Communist women would de facto bring it under the influence of the PCI. The Italian Communist Party tried to perform a normative and normalizing task. By the logic of the Cold War, women (...) were relegated to deal mainly with the defence of peace, both nationally and internationally.From the international point of view, UDI was among the founding organizations of the Women’s International Democratic Federation. Gradually, the Unione began to accrue dissent even within the WIDF, leading to an internal struggle on the path to emancipation that the organization was already developing within its national context. This article invites the view that the Europeanization of an antitotalitarian “collective memory” of communism reveals the emergence of a field of anticommunism. This transnational field is inextricably tied to the proliferation of state-sponsored and anticommunist memory institutes across Central and Eastern Europe (CEE), but cannot be treated as epiphenomenal to their propagation. The diffusion of bodies tasked with establishing the “true” history of communism reflects, first and foremost, a shift in the region’s approach to its past, one (...) driven by the right’s frustration over an allegedly pervasive influence of former communist cliques. Memory institutes spread as the CEE right progressively perceives their emphasis on research and public education as a safer alternative to botched lustration processes. However, the field of anticommunism extends beyond diffusion by seeking to leverage the European Union institutional apparatus to generate previously unavailable forms of symbolic capital for anticommunist narratives. This results in an entirely different challenge, which requires reconciling of disparate ideological and national interests. In this article, I illustrate some of these nationally diverse, but internationally converging, trajectories of communist extrication from the vantage point of its main exponents: theanticommunist memory entrepreneurs, who are invariably found at the helm of memory institutes.Inhabiting the space around the political, historiographic, and Eurocratic fields, anticommunist entrepreneurs weave a complex web of alliances that ultimately help produce an autonomous field of anticommunism. Many professional football clubs in Europe have youth academies. The business model of such academies is that a club invests resources in training a player and then, when the player is old enough to sign an adult contract, either sells the player or offers him an adult contract. According to Fédération Internationale De Football Association (FIFA), international transfers of players are only permitted if the player is over the age of 18. There are five exceptions to this rule. (...) One of them is that if the player is between 16 and 18 and the transfer takes place within the territory of the European Economic Area (EEA), then an international transfer is allowed. This article is a discussion of the FIFA rules that mandate non-uniform age limits for when players can first transfer to clubs within the EEA area. The conclusion of the article is that FIFA is morally unjustified in setting a higher minimum age for transfer to EEA clubs for non-EEA players than for EEA players. The article first develops an argument for its conclusion. It then discusses, and rejects, the five best objections to this argument. (shrink)

This article argues the main following points. (1) Communism was fatefully dependent upon the action or inaction of its top leaders because of the vulnerability of the hyper-centralized power and hyper-centralized defense of the ruling class and the ruling party. No one was really able to seriously predict the historical contingencies such as Gorbachev and Yeltsin that played a decisive role. The most that social scientists and analysts could safely claim was that communism had become unsuccessful and problematical (...) to such an extent that force alone could maintain it. However, given the overall history of communism, who could have anticipated that such force would not be used. (2) The United States is toiling now in an overwhelmingly difficult and dangerous transition, not only from a ‘superpower’ to ‘merely’ a big power, but from a totalistic and laissez-faire capitalism to a limited and state-regulated capitalism. It is the most efficacious way of production and primary distribution. However, unless capitalism, national and global, becomes regulated and combined with some kind of socialism (solidarism) that is yet to be established, global crises will keep recurring. The best chance for enlightened socialist (solidaristic) humanism lies in secondary distribution based on equality and justice as its fundamental principles. (3) The very term ‘superpower’ suggests a kind of superhuman, almost divine power. The United States does not have such power because (among other things) apocalyptic weapons are at the disposal of some considerably weaker states (in every other respect). (4) The possibility of the self-destruction of humankind has become the over-determination of all other over-determinations in history. It follows that auto-apocalypse must be separated from the categorical and epochal dichotomy between modernity/ modernism and postmodernity/postmodernism and given an absolute priority, both theoretical and practical. This break should be characterized as post-postmodernity and reflection upon it as post-postmodernism. We are in vital need of a total anti-apocalyptic turnaround in overall thought, sensitivity, activity and organization. Unfortunately, it can now safely be predicted that more and more states and societies, even those founded on (internal) freedoms and desirous to maintain them, will become transformed into states and societies focused on the struggle for survival in the face of auto-apocalyptic threats. I believe that confronted more and more with such threats liberalism will actually, and later probably also explicitly, yield the place of the fundamental operative (unlike declarative) view of the world, ideology, imagology, and principle of social organization — to humankind existentialism. We have entered an existentialist ‘end of history’ instead of the proclaimed liberalistic ‘end of history’. (shrink)

Third, a belief that salvation is only to be found within the Church and that the True Faith must be spread throughout the world, by force if necessary. (These are the beliefs of Communists.) Fourth, that the priesthood, which alone has the right to interpret the Scriptures, has enormous power, physical east of the Iron Curtain and spiritual over the faithful in partibus. Fifth, that this power is used to secure an undue share of wealth for the priesthood at the expense of the rest of the population. Sixth, that bigotry, and the hostility that it engenders, is a potent source of war. Every one of these evils was exhibited by the Catholic Church when it had power and would probably be exhibited again if it recovered the position it had in the Middle Ages. United States federal regulations for pediatric research with no prospect of direct benefit restrict institutional review board (IRB) approval to procedures presenting: 1) no more than "minimal risk" (§ 45CFR46.404); or 2) no more than a "minor increase over minimal risk" if the research is commensurate with the subjects' previous or expected experiences and intended to gain vitally important information about the child's disorder or condition (§ 45CFR46.406) (DHHS 2001). During the 25 years since their adoption, these regulations have (...) helped IRBs balance subject protections with the pursuit of scientific knowledge to advance children's welfare. At the same time, inconsistency in IRB application of these regulations to pediatric protocols has been widespread, in part because of the ambiguity of the regulatory language. During the past decade, three federally-charged committees have addressed these ambiguities: 1) the National Human Research Protections Advisory Committee (NHRPAC) (Washington, DC), 2) the Institute of Medicine (IOM) Committee on the Ethical Conduct of Clinical Research Involving Children (Washington, DC); and 3) the United States Department of Health and Human Services Secretary's Advisory Committee for Human Research Protections (SACHRP) (Washington, DC). The committees have reached similar conclusions on interpretation of language within regulations § § 45CFR46.404 and 406; these conclusions are remarkably consistent with recent international recommendations and those of the original National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research (1977) report from which current regulations are based. Drawing on the committees' public reports, this article identifies the ethical issues posed by ambiguities in regulatory language, summarizes the committees' deliberations, and calls for a national consensus on recommended criteria. Introduction. In the political science literature, there are several main approaches that explain the weakness of the political parties’ institution in Russia. These concepts point to reasons that are outside political parties. This study attempts to link the low status of political parties in Russia with the quality of party top management, in particular, with the parties’ regional leaders (United Russia, the Communist Party of the Russian Federation, the Liberal Democratic Party and A Just Russia). The purpose of the (...) study is to create a collective portrait of the heads of regional branches of parliamentary political parties. Methods. The identification of elites in this work is carried out within the framework of the positional approach. The main method for collecting and analyzing data is the biographical approach. Scientific novelty. An additional explanatory model of the weakness of political parties’ institution in Russia is proposed - the quality of party leadership. The factors influencing the internal party processes are considered. Results. A comparative analysis of the social and professional characteristics of the leaders of the parties’ regional branches, as well as their career trajectories is carried out. The average statistical portrait of the regional leaders of parliamentary parties is revealed. Conclusions. The head of the party’s regional branch is a middle-aged man with a higher technical education who has not served in the Armed Forces of the Russian Federation and is a native of the deputy corps or the business community. The obligation to provide reasons may appear rather a simple and straightforward, but in actual practice—as the mutually antagonistic Weiss rulings of the CJEU and the German Bundesverfassungsgericht amply demonstrate—is fraught with constitutional complication. On the one side, there lies the concern with a deeply intrusive form of judicial review which substitutes judicially determined “good” reasons for those of the reviewee decisionmaker—legislatures, administrative agencies, or, as in Weiss, the European Central Bank. Written from the point of view of a campaigner against economic globalisation, this paper looks at the recent Multilateral Agreement on Investment (MAI) and the campaign against it which eventually led to its demise. It looks at the nature of the diverse coalition of interests opposed to the MAI, and in particular their use of e‐mail and the Internet, and argues that the success of this campaign has lessons beyond the immediate victory over the forces promoting the MAI. It is argued that the emergence of anti‐globalisation action also contains the seeds of new grassroots forms of ethical social organisation, based in specific but interconnected localities, a cosmopolitan interlocalism, and that this in itself remains a key feature in the short‐ and long‐term success of such action. Intersex—the fact of bodies neither typically male nor female, together with the grim history of its medical management—was a topic for feminist theory before there was such a thing as intersex activism. Indeed, critical academic scholarship about intersex supported the consciousness raising that made an intersex activist movement possible. Activist engagement, in turn, has expanded the understanding of the theorists whose work is responsive to that activism. Central to the thinking about intersex are the questions of identity and its limits (...) that are an important focus of the work of Gloria Anzaldúa, whose narrative suggests she had a condition associated with intersex. While her work largely predates intersex activism, it powerfully encapsulates the tensions displayed in contests over identity that have become central over the last 15 years, and furthermore offers insight into the challenges that lie ahead. From the viewpoint of its Stalinist-era creators, the IKKN/INS could at best be described as a mixed success. Despite heroic efforts, it failed to train the cadres that might have permeated Polish scholarship with Marxism-Leninism. If it was the major channel for transmitting Soviet experience to Polish academia, then Poland's universities would not learn to be Soviet—the Polish historian Jerzy Halbersztadt has made the point that the institute was the only direct conduit of Soviet experience into Polish academic life. It (...) even had a major role in educating some of Poland's most famous critical thinkers, although they, unlike their master Adam Schaff, seem less fond of reminiscing about the institute. Leszek Koŀakowski writes that he does not regard his role in the ideological struggles of the early 1950s as a “source of pride”.90The legacy of the IKKN/INS has also been a mixed one. It was not only a “foundry of revisionists”. For every future critical thinker of world repute, it graduated several cadres who served the PZPR loyally over decades. Adam Schaff recognises this dual legacy. Looking back on a long and active life, he has called the institute a “pearl in my crown”.91 Its members filled top party and government posts throughout the history of People's Poland. Andrzej Werblan served as Central Committee secretary and a member of the Politburo, Sylwester Zawadzki became minister of justice, Stanisŀaw Wroński was minister of culture, Mieczysŀaw Jagielski was the Politburo member who negotiated the Gdańsk accords, Stanisŀaw Kania succeeded Edward Gierek, and Mieczysŀaw Rakowski acted as General Jaruzelski's Party First Secretary.92Undoubtedly much of the institute's strange course is to be attributed to the designs of Adam Schaff. Despite his Moscow training, Schaff retained an attachment to the Polish academic milieu which had formed him. He may have believed in Stalinist doctrine, but he also believed that this doctrine would show its superiority in competition with other views—even if the competition was far from a fair one. Of course, Schaff tried to retain ultimate control, and to play, as he now calls himself, the “grey eminence”. Nevertheless, his was a very unstalinist way of propagating Stalinism, and he must be given credit for helping to keep a spirit of intellectual inquiry alive in Poland during the dark years of the early 1950s.Yet Schaff tends to exaggerate his personal role in educating philosophers, dissidents and critical thinkers. This tendency is itself a legacy of the Stalinist period and its concentration of power. Stalinists view the present as their personal creation and therefore reject all criticisms of the past. At the final meeting of the Crooked Circle Club in 1962, Schaff encountered unwonted criticism from, among others, Andrzej Walicki. Schaff shot back at him: “You are ours, you are our creation, a creation of socialism ... we educated you, and we didn't do such a bad job.” But far from being a “creation” of Schaff's, the non-party member Walicki had been denied admission to graduate studies in philosophy. He felt relieved when those in attendance, who knew him better than Schaff did, burst out laughing.93The point is that the Polish intellectual world maintained its integrity outside the IKKN/INS, and in the end it was the institute which merged into the Polish intelligentsia, rather than the opposite. After 1957 the non-Marxist sociologists and philosophers made their way back to academia, and were joined by many former INS staff members. The basic unity of Polish social science training, and of the Polish intelligentsia, was restored.94Of course in a larger sense the fate of the IKKN/INS had little to do with the designs of its master. Schaff admits as much, proclaiming that “I did this because I did not know what I was doing!” If he had been asked to start such a project five years later, the answer would have been: “No!”95 The fatal flaw of the Institute for Training Scientific Cadres was cadres: Poland did not have them. By 1956, Schaff and the party leadership, and perhaps Soviet advisers as well, had learned that one could not create an elite party scientific institution almost out of nothing. It would either be party or scientific, because apparatchiki could not become scientists, scientists would not become apparatchiki, and students could not produce teachers. In the Stalinist period, Polish intellectual life had stood in the shadow of the party; yet during the Thaw the relationship was reversed—increasingly the tiny party training institute was engulfed by the shadow of the resurgent Polish universities. Talented young people, even those in the party, made their way into the traditional higher educational establishment.The IKKN/INS did not, therefore, fail because of its own failings, nor succeed because of its own successes. It was a failed part of a failed whole. To succeed, “mild” revolution would have required decades, and Poland's Stalinists had only a few years. To make matters worse—or better, depending on viewpoint—they did not use these years in a conventional Stalinist manner. Under Schaff's guidance and at somewhat erratic Soviet bidding, the institute became an awkward series of half-measures, reminiscent of much of Polish Stalinism. This essay combines information on the recent ISUD Sixth World Congress Humanity at the Turning Point: Rethinking Nature, Culture, and Freedom and some reflections inspired by presentations and discussions at the congress. It is focused on the presentation of one of the keynote speakers, Karl-Otto Apel, entitled “Discourse Ethics, Democracy, and International Law: Toward a Globalization of Practical Reason”. Apel argued that the transcendental-pragmatic foundation of morality serves as the ultimate basis for the universal conception of law, e.g., of (...) human rights. It establishes the transcendental basis of the idea of democracy, and at the same time establishes a regulative principle for a possible critique of the democratic states. Apel discussed the question of a political order of law able to represent the idea of human rights. In his approach to it, he referred to Kant’s idea of “a federation of free states” (as opposite to a “world state”) in the solution of the problem of a cosmopolitan system He noticed the tension between two orientations of international law: one towards “human rights” and hence a cosmopolitan law of single citizens and the other towards the sovereignty of single states. He asserted that the universal conception of law cannot be reduced to the legislative autonomy of any state. Consequently, the universal conception of human rights cannot be adequately realized either by particular democratic states or by a world state as a despotic superpower. Apel concluded that an adequate institution for the current debate regarding the issues of global peace and security can only be a federation of nations like the UN, the meta-institution of global discourse and the political representation of international law. At the heart of the essay is Kant’s cosmopolitan ideal and its relevance for today’s discussions about peace and security. Attention is paid to the attempts to rethink Kant by Karl-Otto Apel, Jürgen Habermas, Jaques Derrida, Martha Nussbaum, and David Held, among others. Some of the authors indicate the tension between the sovereignty ofstates and the universality of human rights. Other authors criticize cosmopolitanism as overly unifying in contrast to the socio-cultural diversity of societies. The essay draws a contrast between two tendencies concerning international relations. One is the current neoconservative course toward American domination throughout the world. An alternative to this is the philosophers’ call for “the cosmopolitan model of democracy” and strengthening the network of transnational grass-roots movements and international institutions, including the UN. I propose in this essay to briefly describe some of the main current stakeholders who issue guidance on the ethics of human subjects research. This will be preceded by a very brief historical introduction.Prior to World War II, as far as I have been able to ascertain, there were no international efforts to regulate human experimentation. National activities were few and far between. One exception was a Directive on Human Experimentation issued in December 1900 by the then Prussian Minister (...) of Religious, Educational and Medical Mairs. This was followed by a Circular on innovative therapy and scientific experimentation promulgated by the then Reich Minister of the Interior in February 1931. Just over five years later, in April 1936, the Bureau of the Medico-Scientific Council of the People’s Commissariat for Health of the Russian Socialist Federated Soviet Republic, the main constituent Republic of the then Union of Soviet Socialist Republics, issued an Advisory Resolution on the procedures for testing new medicinal substances and methods which may present a hazard for the health and life of patients. Since the mid-1980s, internal corporate investigations have become commonplace in the U. S., with an upsurge occurring as a result of the corporate scandals of 2001-02 involving Adelphi Communications Corporation, Enron, Merck & Company, Riggs Bank, and other companies accused of financial malfeasance. After an introduction, this article first presents the U. S. public policy framework (as implemented through the U. S. Sentencing Commission, the U. S. Department of Justice, and the Securities and Exchange Commission) encouraging the use of corporate (...) internal investigations and self-reporting of these results to federal authorities; second, evaluates this framework, identifying the public policy issues inhibiting companies from using corporate internal investigations and self-reporting significant results; third, proposes a policy incentive regime which attempts to ameliorate these outstanding issues; and fourth, offer policy recommendations and suggestions for further research on this topic, including increasing the maximum deduction in the Organizational Sentencing Guidelines Culpability Score available to a firm for development of an Effective Compliance and Ethics Program (from 3 to 5 points), and self-reporting the results of an internal investigation (from 5 to 7 points); evaluating the effectiveness of these enhancements in legal incentives over a period of 5-7 years after implementation; instituting a formal federal government effort to educate the American business community on the corporate reputation (and financial) benefits of an effective compliance program; and protecting attorney-client privilege and work product protection, through legislative action, to encourage company executives and directors to utilize independent, outside attorneys to conduct fair, comprehensive, and impartial internal investigations. In 2005, The International Federation of Organic Agricultural Movements (IFOAM) developed four new ethical principles of organic agriculture to guide its future development: the principles of health, ecology, care, and fairness. The key distinctive concept of animal welfare in organic agriculture combines naturalness and human care, and can be linked meaningfully with these principles. In practice, a number of challenges are connected with making organic livestock systems work. These challenges are particularly dominant in immature agro-ecological systems, for example (...) those that are characterized by industrialization and monoculture. Some of the current challenges are partly created by shortages of land and manure, which encourage zero-grazing and other confined systems. Other challenges are created in part by the conditions for farming and the way in which global food distribution systems are organized, e.g., how live animals are transported, how feed is traded and transported all over the globe, and the development of infrastructure and large herds. We find that the overall organic principles should be included when formulating guidelines for practical organic animal farming. This article explores how the special organic conceptions of animal welfare are related to the overall principles of organic agriculture. The aim is to identify potential routes for future development of organic livestock systems in different contexts and with reference to the specific understanding of animal welfare in organic agriculture. We include two contrasting cases represented by organic livestock systems in northwestern Europe and farming systems in tropical low-income countries; we use these cases to explore the widely different challenges of organic livestock systems in different parts of the world. Revolutions in physics all embody theoretical unification. Hence the overall aim of the present book is to unfold Einstein’s unificationist modus operandi, the hallmarks of actual Einstein’s methodology of unification that engendered his 1905 special relativity, as well as his 1915 general relativity. To achieve the object, a lucid epistemic model is exposed aimed at an analysis of the reasons for mature theory change in science (chapter1). According to the model, scientific revolutions were not due to fanciful creation of new ideas ‘ex nihilo’, but rather to the long-term processes of the reconciliation, interpenetration and intertwinement of ‘old’ research traditions preceding such breaks .Accordingly, origins of scientific revolutions lie not in a clash of fundamental theories with facts, but of “old” mature research traditions with each other, leading to contradictions that can only be attenuated in a more general theoretical approach. In chapter 2 it is contended that Einstein’s ingenious approach to special relativity creation, substantially distinguishing him from Lorentz’s and Poincaré’s invaluable impacts, turns to be a milestone of maxwellian electrodynamics, statistical mechanics and thermodynamics reconciliation design. Special relativity turns out to be grounded on Einstein’s breakthrough 1905 light quantum hypothesis. Eventually the author amends the received view on the general relativity genesis by stressing that the main reason for Einstein’s victory over the rival programmes of Abraham and Nordström was a unificationist character of Einstein’s research programme (chapter 3). How does a country repair its harm to a vulnerable minority targeted during times of national fear because of race? How did the United States redress its then popular yet unconstitutional WWII incarceration of 120,000 innocent Japanese Americans in desolate barbed wire prisons without charges, hearings, or bona fide evidence of military necessity? In response to a Congressional inquiry, political lobbying, and lawsuits, the Civil Liberties Act of 1988 directed the President to apologize and authorized over one billion dollars (...) in reparations. Congress also created a fund to educate the public about the government’s false assertion of “national security” to restrict civil liberties. Some considered redress a tremendous victory — rewriting history and personal healing. Others questioned reparations for one U.S. group but not others. Japanese American Redress served as a catalyst for reparations movements worldwide. This paper examines its genesis, legal implementation, and apparent effects. It also explores wide-ranging political mobilization and social meanings of redress and “unfinished business”. Reparations cannot be measured by laws alone. Diverse communities must engage contested questions of history, justice, and belonging. Reparations claims face often unforeseen benefits and limitations. This paper investigates the key drivers behind the origins of value-for-money (VFM) audit in Canada and the aims, intents, and logics ascribed by the original proponents. Drawing on insights from governmentality and New Public Management, the paper utilizes analysis methods adapted from case study research to review a wide range of primary documentation (e.g., Hansards from the Public Accounts Committee, House of Commons debates, the so-called Wilson report and the FMCS study) and secondary documentation (newspaper articles, Office of the Auditor (...) General internal publications, journal articles). Major findings indicate a rise of a management consulting culture within the Auditor General’s office following the appointment of James Johnson Macdonell. VFM legislation effectively operationalized practices drawn from management consulting expertise by invitation of the consultant. It was offered as an answer to the growing scope and size of government, which had become problematized by the Auditor General in terms of parliament losing control over the public purse. The Auditor General’s invocation of financial crisis led to a substantial broadening of mandate and increase in resources for that office. (shrink)

Switzerland is internationally known for its progressive animal laws and for its innovative tools in law enforcement. In 1992, the Canton of Zurich introduced a public lawyer vested with the task of representing animals’ interests in criminal procedure, known as the Animal Protection Lawyer. The APL had the power to access information about court proceedings, study pending court cases, and intervene on behalf of victim animals. This enforcement tool set a precedent across the world. It amounted to a recognition of (...) animals as de facto victims and created an “equality of arms” for human and animal parties in criminal procedure. In a historic move in 2014, the Zurich parliament removed the APL from office—by mistake, as some maintain. Meanwhile—unnoticed by many—the Canton of Berne maintained a state agency vested with the very same powers as those the APL had, called the Dachverband Berner Tierschutzorganisationen. Though the DBT operated as an established agency for over 2 decades, in August 2017, a criminal court in Berne denied the DBT standing, arguing that the laws conferring on it the right to represent animals violate the federal law on criminal procedure. In July 2018, the Supreme Court delivered its judgment, and effectively stripped the DBT of its rights to represent animals in criminal proceedings. This article describes these recent shifts in criminal animal law in detail and analyzes the sociopolitical factors that gave rise to them. Special attention is paid to the question of what is left for Switzerland as a role model in animal law given ongoing deregulations, particularly as recent cases in the United States point to an incremental emancipation of animals as victims. The article discusses current alternatives to the APL and the DBT and puts their promises under scrutiny. The analysis reveals that these alternatives skirt the main obstacles faced by animals in criminal procedure and threaten the democratic will of the Swiss people. Two alternatives are discussed that can help Switzerland overcome its insufficiencies: the organizational right to appeal and victim rights for animals in criminal procedure. Using these alternatives, the article calls for the global emancipation of animals as the proper victims of crimes and for furnishing them with correlating rights to enforcement, including rights to representation. Most new drugs are protected by pharmaceutical patents, which give the patent holder exclusive control over that drug’s supply for 20 years. When the patent term expires, the drug becomes available for generic production by any company. The resulting competition typically leads to dramatic reductions in price. In Brazil, generic drugs are on average 40% cheaper than reference or brand-name drugs. In the United States, the Federal Drug Administration reports up to 85% price differences. Consumers in India have witnessed (...) more than 100-fold price reduction for antiretroviral drugs due to generic production. The article examines the provisions of the catechisms of the Ukrainian Greek Catholic Church regarding the war and its challenges, as well as the defense of the Motherland. A comparative analysis of relevant thematic instructions in the Catechism “Christ is our Easter” (published in 2011), the Catechism for youth “We walk with Christ” (published in 2021) and the “Catechism of the Christian Warrior” (published in 2022) was carried out. It was determined that the provisions of the UGCC's own fundamental doctrinal (...) documents, its Catechisms, regarding the problems of war and defense of the Motherland, were formed, clarified and supplemented according to the circumstances and needs of the time. The catechism of the UGCC “Christ is our Easter” contains general Christian considerations on the subject under consideration, which are principled, establishing, and refer to how civilized peoples should conduct themselves. The catechism for youth, created in the previous years of the undeclared Russian Federation's “hybrid” war against Ukraine, covers the issues related to the war and the defense of the Motherland in a substantive way and closer to current Ukrainian realities, although it still has some idealistic approach. The Catechism of the Christian Warrior, the preparation of which was completed and the publication was carried out during the full-scale military offensive of the aggressor, is a set of thorough and competent advises for Ukrainian soldiers, where things are called by their names, and there are no provisions that can cause doubts due to experience and be problematically achievable for implementation. Therefore, it is concluded that especially this Catechism, together with and in addition to the two previous ones, is a useful and timely contribution of the UGCC to the instruction of Ukrainians during the war, and therefore to Ukraine's victory over the enemy. Recent interpretations of Kant’s international political philosophy have argued that the formation of a coercive world-state (Völkerstaat) is morally required. While these interpretations highlight the importance of a strong world government, they ignore Kant’s alternative to a Völkerstaat, a world-federation (Völkerbund). For both theoretical and practical reasons, the Völkerbund plays a crucial role in cosmopolitan right, and Kant can only justifiably reject the formation of the Völkerstaat because of the structure of the Völkerbund. This article explains the constitution (...) and functions of the Völkerbund, and thereby shows why Kant was not ultimately committed to supporting a coercive world-state. (shrink)

In this paper I discuss a new conception that has arrived relatively recently on the scene, in the context of the debate over the inclusion of transwomen (hereafter TW) in female sport. That conception is ‘Meaningful Competition’ (hereafter MC) – a term used by some of those who advocate for the inclusion of TW in female sport if and only if they reduce their testosterone levels. I will argue that MC is not fair. I understand MC as a substitute (...) concept, as an attempt to substitute for the perfectly serviceable concept of fair competition. It is an attempt at conceptual engineering that should be resisted. This is important because some International Federations have accepted MC as good coin, and the underlying theory of MC, which I explicate for the first time, underpins the stance taken by the IOC (International Olympic Committee) in its Framework Document. To establish that the inclusion of TW in female sport meets the criteria of MC in the sense I explicate here, does not show that the inclusion of TW in female sport is fair. Such inclusion is not fair, and the proper currency of sport is fair competition. ‘Meaningful Competition’, on the other hand, is a snare and a delusion. (shrink)

Besides 11 revised full papers, selected from the 24 submissions to the OCS workshop held in conjunction with the First International Conference on Principles and Practice of Constraint Programming, CP '95, held in Marseilles in September 1995, the book includes three comprehensive background papers of central importance for the workshop papers and the whole field. Despite reservations over the status of esports as sports, the International Olympic Committee (IOC) has, for policy reasons, encouraged International Federations to pursue links with providers of ‘virtual and simulated’ sports, in part by the introduction of an event, the Olympic Virtual Series, first held in 2021. In providing an account of ‘virtuality’ and ‘simulation’, we query the theoretical basis of the Olympic Virtual Series. In particular, we query the IOC’s use of the term ‘virtual’ in the (...) description of two very different activities: what it calls ‘physical virtual sports’ (which we argue are simply Olympic-type sports – real sports! – and should just be called ‘sports’) and ‘non-physical virtual sports’ (which we argue are not sports at all, and should be recognized for what they are – computer games). Abstract. The theory-change epistemological model, tried on maxwellian revolution and special relativity genesis, is unfolded to apprehend general relativity genesis. It is exhibited that the dynamics of general relativity (GR) construction was largely governed by internal tensions of special relativity and Newton’s theory of gravitation. The research traditions’ encounter engendered construction of the hybrid domain at first with an irregular set of theoretical models. However, step by step, on revealing and gradual eliminating the contradictions between the models involved, the hybrid (...) set was put into order with a help of equivalence principle. A hierarchy of theoretical models starting from the crossbreeds and up to usual hybrids was moulded. The claim to put forward is that Einstein’s unification design could be successfully implemented since his programme embraced the ideas of the Nordström research programme, as well as the presuppositions of the programme of Max Abraham. By and large Einstein’s victory over his rivals became possible because the core of his research strategy was formed by the equivalence principle comprehended in the light of Kantian epistemology. It is stated that the theories of Nordström and Abraham contrived before November 25, 1915, were not merely the scaffolds to construct the GR basic model. Besides being the title of an EP by The (International) Noise Conspiracy, “Bigger cages, longer chains!” is an anarchist rallying cry. It’s meant to ridicule those political activists who compromise their ideals, make demands and then settle for partial concessions or, to put it bluntly, bargain with the Man. In the T.V. series Mr. Robot, Christian Slater plays the anarchist leader of a hacktivist group known as fsociety. Mr. Robot won’t negotiate with the FBI and E(vil) Corp for bigger (...) cages and longer chains. He tells Elliot Anderson, the young cybersecurity expert and hacker, “We live in a kingdom of bullshit!” Victory over the tyranny of corporations and states requires radical means to achieve radical ends. Mr. Robot wants freedom without limits, total liberation from corporate and statist control, and the opportunity to live in a world without bullshit. Mr. Robot’s objective is to free citizens of first-world nations from the cages of consumer debt and citizens of third-world nations from the shackles of extreme poverty. Meeting half-way will not do. So what are the inspirations for Mr. Robot’s hacktivist philosophy? The most proximate sources are David Graeber’s anarchism, which also influenced the Occupy Wall Street movement, and the hacktivist group Anonymous’s moralfaggery, that is, the policy of some of its members to use collective computer hacking to serve the greater good. Candidates for more remote sources are Marxism and pragmatism; the former, a blueprint for freeing the working class from their bourgeois oppressors; the latter, a philosophy of action, intelligent inquiry and democratic reform. Some might object that pragmatism is too conventional to be compatible with the radical ideas that motivate Mr. Robot’s worldview. Hacktivism demands action, not mere thinking! But any organized social-political movement requires a well-thought-out plan as well as a vision of what its participants hope to achieve. Since pragmatism is a philosophy of action and reform, it’s possible that Mr. Robot is a closet pragmatist! (shrink)

Immanuel Kant’s position on international justice is beset by some troublesome inconsistencies, most notably a conflicted set of views on the status of federations as suitable alternatives to a world state. It is tempting for contemporary readers to interpret Kant’s indecision as a lack of commitment or resoluteness. Closer inspection demonstrates that this problem involves deeper paradoxes, rooted in the concept of sovereignty. On this matter, Kant’s Rechtslehre is the source of the difficulties found in the “popular” essays. Kant’s (...) vacillating position on the proper institutional end for international relations is attributable to the fundamentally “permissive” character of his concept of right. Rechtslehre doctrines entail a form of skepticism, from which a coherent cosmopolitan program cannot possibly be derived. (shrink)

IntroductionDespite the need for trained physician ethicists, fellowships in clinical ethics are limited and primarily offered to thosewho have completed a graduate degree. The standardization of credentialing for clinical ethics consultants (CECs) and the restructuring of undergraduate medical education allow innovative models to train CECs that can provide an expanded opportunity for formal ethics training at an earlier stage.MethodsAt the University of Michigan Medical School we developed, implemented, and evaluated a pre-doctoral clinical ethics fellowship program from 2017 to 2019 for (...) senior medical students, designed to meet established competencies for CECs. Consultation notes from the beginning and end of the fellowship program were randomly selected for each fellow and independently rated by two faculty ethicists who used the validated Ethics Consultation Quality Assessment Tool (ECQAT).1 Inter rater reliability and trends in scores over time were calculated.ResultsThree students successfully completed the fellowship at the University of Michigan Medical School, conducted at least 50 formal ethics consultations, and spent approximately 40 hours a week on service for a minimum of six months. All students finished the fellowship with teaching and policy development experience, first-authored peer-reviewed manuscripts, and national presentations. The fellows demonstrated improvement in their ECQAT overall holistic rating score; all ended their fellowship with a holistic score of adequate or above. There was 92 percent agreement between raters withrespect to the acceptability of the fellows’ ethics consult notes. Two fellows have taken and passed the Healthcare Ethics Consultant-Certification (HEC-C) exam offered by the American Society for Bioethics and Humanities (ASBH).ConclusionsIntegration of a pre-doctoral fellowship model that meets professional certification standards for clinical ethics consultation creates an opportunity for medical students to become trained CECs early in their career. Scientific socialism as developed by the Social Democratic Party of Germany, the world's largest workers' party, and the Second International, basically a creation of German socialists, viewed utopianism as empirically unverifiable. The publication, wide circulation, and enormous success in Germany of Edward Bellamy's Looking Backward therefore posed a strong challenge to the leaders of the SPD, Karl Kautsky and August Bebel, and it attracted their criticism on several occasions. Such high-level condemnations of Bellamy call for an explanation. The SPD, (...) freshly out of illegality in 1890, scored a decisive victory over Bismarck, and the party's big electoral gains led to utopian hopes among the rank and file. In this expectant milieu, Looking Backward was interpreted as a model for immediate action. However, socialist leaders saw it differently. Kautsky and Bebel reasoned that the immediatism of the American utopia flagrantly violated the ineluctable tendencies of history, recklessly rushed historical destiny, and put the achievements of the socialists at risk. It was not without irony that Kautsky found the absence of utopianism one of the SPD's greatest accomplishments. It was into this utopian vacuum that right-wing futuristic blueprints increasingly moved, portraying Caesaristic leadership, interclass harmony, world power, and racial exclusivity to a rapidly expanding audience. By rejecting future gazing, as exemplified by their rebuff of Looking Backward, socialist leaders failed to wage an extended cultural campaign for hegemonic influence over sectors other than the working class. Their claim that they essentially had no ideals to realize and their adherence to the strategy of fatalistic waiting for the collapse of capitalism came at a high price, as their inaction in face of and even support of colonialism and World War I would reveal.
